Aryan Khan Case - Drug Abuse - NDPS Act

As you all know that it is very much discussed these days i.e., Aryan Khan case & Narcotics related matters. It ( Aryan Khan case & Narcotics related matters ) was first discussed when Sushant Singh Rajput died. And it was controversial whether it was suicide or murder? And some drugs and drug-related things came out in it. After Sushant Singh case the connection of Bollywood actors and their relatives and persons related with them associated with drugs related matters and a lot of people made many allegations against each other.NCB is continuously doing its work whose full form is Date. Narcotic drugs mean drugs that are narcotic drugs. In Hindi, it is called Swapak Aushadhi. So in India it means buying or selling such narcotic drugs is an offense and it is regulated in Narcotic NDPS. The full form of NDPS is the Narcotic Drugs and Psychotropic Substance Act, 1985.

So you will understand that when some other celebrity or any named person is involved in any crime, it? Or if some anti-religious thing is going on, then along with it, conspiracy theory also takes its own place from the council simultaneously. Some people say what is this amount and different types of evidence are being brought, Different political parties are holding press conferences. You can see it all on social media or you will be already seeing all this.

Now some people are saying that Aryan Khan is innocent. Some people are saying that he should not be treated like this at such a young age. Various such things are going on and some people are also saying that BJP is involved in this. And some people are saying that this is a complete political matter, but I understand, whenever someone has accused means If activation is imposed, the court should allow the law to let the police do their work. And we should have faith in the judiciary of the country. How else will the country run if we do not trust the judiciary? If the rules do not follow the law, how will this country run? So we have to believe in our law and order situation and believe that NCB and law and Courts will do their job properly. And even if these systems are not doing their job properly, then the High Court and Supreme Court are sitting to crack down on these systems.

Behind all these conspiracies means what is the statement of Salman Khan ?. What statement did Sunil Shetty give? you must be seeing all this on TV on social media. I am only going to do this work that I am going to tell you what law this is. Under which law is it regulated? What is the punishment for this? And what are the clauses in it? Because I am not here to give air to any Congressman. I want to make you aware of the law.

So let us know what is this NDPS Act after all?

It came in 1955. The name of it in English is Narcotic Drugs and Psychotropic Substance. And in Hindi, it’s called, Swapak Aushadhi our Manahprabhavu Padartha Adhiniyam, 1955. So there are some drugs that affect the mind. This law talks about those drugs.  This Act has Six Chapters. And these are divided into some parts.

1. Preliminary:-  Some words have been defined in it. And also where and when it will be applicable, it has been told about it.

2. National Fund for Control of Drugs Abuse:- It talks about national funds which is necessary or needful to control drug abuse.

3. Prohibition Control and Regulation:-  It has provisions about prohibition and also tell about its regulation.

4. Offences and Penalties:- What is the Punishment for the different types of Drug abuse.

5. Procedure:-  Provision in this cycle about which process will be adopted.

5A. Seizure, Freezing & Forfeiture of Property:- If a person acquires such a property, which is acquired by selling and buying drugs.

6. Miscellaneous

To know what are narcotic drugs, it is important to know that there are many such words in which they are given. A word that comes in Cannabis is called hemp. So what are the things that come in it, it comes in charas ganja. These two come in this and a Mixture which is made by mixing these two or a drink which is made by mixing charas and ganja. And it has been told about a cannabis plant, then it has been told about the coca. Which we all know by the name of cocaine in the common colloquial language. Which is made from the leaves of the Coca plant And what is the meaning of Coca, that is also defined in this act.

Then in Section 2(15) defines Opium. Which we call in common colloquial language.

So why is drug use not considered as right?

Because it has spoiled the mind and spoils the mind as well as the body. So if someone youngster is engaged in the business of selling and buying drugs and also starts to consume them, then he will neither useful for the development of the country nor will be for the work of his family. So there was another Sushant Singh Rajput case. Those Sushant Singh Rajput had committed suicide, which was later linked to the murder of the media or the system. Was saying it was not suicide. If it is a murder, then after this case some drug cases were reported and the connection of Bollywood came out in it, then NDPS is continuously raiding in this matter. And you all would also know that under this raid there are Aryan Khan and some other people who have been arrested by NCP.So what section has been imposed on these people? Which section has been imposed on Aryan Khan? I will explain this. One section is very important which is imposed on Aryan Kann. i.e., Section 8C. And others are Section 20B, Section 27, Section 35 ( Presumption of mental status ).

Let us see these Sections in detail.

Section 8c:-produce, manufacture, possess, sell, purchase, transport, warehouse, use, consume, import inter-State, export inter-State, import into India, export from India or tranship any narcotic drug or psychotropic substance.

Section 20B:-  produces, manufactures, possesses, sells, purchases, transports, imports inter-State, exports inter-State or uses cannabis, shall be punishable 1[(i) where such contravention relates to clause (a) with rigorous imprisonment for a term which may extend to ten years and shall also be liable to fine which may extend to one lakh rupees;

Section 20 B is very important in Aryan Khan Case. Under this Section, Aryan Khan will be Punishable. It prohibits the Produce, use, manufacture, possess, buying, and selling of it is punishable. Punishment depends on the quantity means how many quantities of cannabis (Charas, Ganja) are found in your possession. If cannabis is found in your possession very low in quantity then you will be punishable with 1-year imprisonment and a 1,0000 fine. And if it is found in more quantity then you will be punished for 20 years imprisonment and a 2,00000 fine. Low quantity means small quantity, and more quantity means commercial quantity. So it will be decided by the Court that which quantity of drugs is possessed by you.

Section 27:- Punishment for consumption of any Narcotic drugs or psychotropic substance.

Aryan Khan’s case went to court and there was an argument for bail in the court but the court has rejected the bail application. Ans sent Aryan in Remand. So the first thing to understand here is that the court has when rejected the bail. . When it appears to the court that such a case is becoming prima facie here.

So it must be visible to the court that such a case is being made here. That is why the court has sent Ayan Kahn to custody. And Aryan Khan has been taken in remand from where interrogation will take place and some people associated with him will also be interrogated.
