The question is, Is it a crime to stalking women on Facebook/send a friend request to a Woman/Girl on Facebook, and for that is there any provision for punishment in the law?
This is a very interesting question which comes into everyone’s mind especially in the mind of boys and in the mind of other people that can we send a friend request over and over again after a Girl/Woman shows disinterest once?
First of all, let me tell you that, if you don’t know that woman and you are sending her a friend request then you are wasting your time because trying to talk to someone without knowing her or doing anything is just a waste of time and Nothing else. Remember that, here you are not wasting your time and You are not passing the time actually time is passing to you and if you keep on wasting time like this, you will not do anything. You will only harm your life.
whether it is a crime to send a friend request to a woman?
Now let’s come to the main question of whether it is a crime to send a friend request to a woman?, then yes, sending a friend request to a woman on Facebook is a crime and for this, there are provisions for punishment in IPC. sending a friend request is a crime and chasing a woman is also considered a crime.
When the Nirbhaya rape case happened in 2012, you can say it was on public demand or for some other reason one good thing was happened after it, after Nirbhaya Rape Case amendments were brought in The CrPC, IPC, and in the Indian Evidence Act, under which stalking a woman or sending a friend request to that woman was considered as an offense.
By this amendment, Section 354D was added in the IPC, Section 354D is a Cognizable offense, which means the police can arrest without warrant in it, against whom the charges have also been made. Police can arrest to accused without a warrant for investigation about the allegations of stalking.
It is clearly written in this Section is that, if you send a friend request to a woman or a girl for the first time, on Facebook or on the other social sites and the woman/girl shows disinterest and she deletes your friend request and refuses to accept your friend request, and after that, you again send a friend request to her. Then it is considered a crime to send a friend request to that woman/girl over and over again after a woman shows disinterest once.
Meaning, if the woman has deleted the request sent by you or the boy, then she has shown her disinterest in a very clear way, and under section 354 D of IPC sending a friend request to that woman, again and again, will be considered an offense.
That means after this you must have clearly understood that you can send a friend request to a woman once, but again and again sending a friend request to her comes under this crime, so that is why after refusing a woman for the first time, and if she shows her disinterest after that Don’t send her friend requests again and again. Like if she blocked your account and you created another account and then sent her a friend request then it will also be considered as a crime of Stalking.
( 1 ) Any man who– follows a woman and contacts or attempts to contact such woman to foster personal interaction repeatedly despite a clear indication of disinterest by such woman or
( ii ) monitors the use by a woman of the internet, email, or any other form of electronic communication commits the offense of stalking :
( 2 ) Whoever commits the offense of stalking shall be punished on first conviction with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine; and be punished on a second or subsequent conviction, with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine.
